Liability Waiver

WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

This Release is executed by volunteer ("Releaser") and Happy Faces Pet Ranch (“Releasee”). Happy Faces Pet Ranch owns and operates an animal rescue intake and boarding facility at 727 Settegast Ranch Road Richmond, Texas 77406 which houses animals that were strays, unwanted, quarantined for health purposes or for other reasons associated with animal rescue (the “Rescue”). I (Releasor) desire to work/volunteer at the Happy Faces Pet Ranch facility and assist the Rescue in housing the animals, caring for the animals and operating the animal Rescue. I (Releasor) understand and acknowledge that such activity carries with it an inherent risk and danger of personal injury including but not limited to being bitten, injured or attacked by an animal and accept employment/volunteer opportunity with full knowledge and assume all risk associated with such activity. In consideration of allowing the Releasor this opportunity, I (the Releasor) voluntarily and knowingly agree to RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Happy Faces Pet Ranch and its officers, employees, agents, representatives, successors, heirs, executors, administrators, assigns, departments, corporations, and any affiliated organizations, entities, or parties in privity with the Rescue, whether named or not named in this Release, from any and all liability, claims, demands, action and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise, while participating in such activities, or while in, on or upon the premises/property where the work is being conducted. I (the Releasor) hereby elect to be employed/volunteer, and participate in said activities, and to enter the above-named premises and engage in such activities knowing that certain risk of harm are or may be inherent in the various activities contemplated herein and that the activities may be hazardous to me and my property. I (the Releasor) ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such activities, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES or otherwise. Further I (the Releasor) AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage or costs, including court cost and attorney’s fees, that they may incur due to my participation in said activities, WHETHER CAUSED BY OR CONTRIBUTED TO IN WHOLE OR PART by any action or failure to act, negligence, breach of contract, or other misconduct on the part of RELEASEES or otherwise. As the Releasor, it is my express intent that this Release and Hold Harmless Agreement shall bind the members of my family and spouse if alive, and heirs, assigns and personal representative if deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above named RELEASEES. I (the Releasor) hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Texas.

IN SUBMITTING THIS RELEASE, I (THE RELEASOR) ACKNOWLEDGE AND REPRESENT THAT I HAVE CAREFULLY READ THIS RELEASE AND FULLY UNDERSTAND ITS CONTENTS AND TERMS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND AN AGREEMENT TO HOLD HAPPY FACES PET RANCH, THEIR OFFICERS, SERVANTS, BOARD MEMBERS, ANGENTS, OR EMPLOYEES (“RELEASEES”) HARMLESS AS STATED HEREIN, AND THAT THIS RELEASE IS A CONTRACT BETWEEN ME (THE RELEASOR) AND HAPPY FACES PET RANCH. Further, IN SUBMITTING THIS RELEASE, I (THE RELEASOR) ACKNOWLEDGE AND REPRESENT THAT I have signed it voluntarily as my own free act and deed; that no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; that I am at least eighteen (18) years of age and fully competent; and that I execute the Release for full, adequate, and complete consideration fully intending to be bound by same.
