Potential Adopters and Visitors Waiver and Release of Liability

This Release and Waiver of Liability (“Release”), in favor of Coastal K9 German Shepherd Rescue (dba Coastal German Shepherd Rescue of San Diego), a California public benefit corporation, its directors, officers, representatives, employees, and agents (collectively, “Coastal”) is by the submitter of this Release as visitor and/or potential adopter (hereinafter “Potential Adopter”).

POTENTIAL ADOPTER UNDERSTANDS THERE ARE KNOWN RISKS. Potential Adopter desires to visit and meet a dog at Coastal’s facility in Valley Center, California. This meeting may include the Potential Adopter bringing his/her own pets, family members, friends, and/or their children to the Coastal property.  Potential Adopter represents and warrants that he/she is physically and mentally fit to safely participate in meeting rescue dogs at Coastal. Potential Adopter also represents and warrants that his/her children are also physically and mentally fit, and of the age and maturity, to safely participate in meeting rescue dogs at Coastal. Potential Adopter recognizes and understands the risks associated with the meeting and handling of animals, displaying and caring for animals, and dealing with the Coastal volunteers, and Potential Adopter understands that there are hazards and risks to persons, especially children, Potential Adopters’ own dog(s), as well as his/her personal property while at Coastal’s property. Potential adopter understands that these hazards may occur from the actions of Coastal volunteers, Coastal dogs, and/or actions of Coastal, its directors, officers, representatives, employees, and/or agents. The Potential Adopter has been advised and understands that the activities are hazardous and involve contact with animals that can be dangerous and unpredictable.

POTENTIAL ADOPTER UNDERSTANDS THE NATURE OF THE RISKS. Potential Adopter understands that working with dogs can be dangerous and may expose the Potential Adopter and their children to hazards and risks that may include, but not be limited to: Animal and dog bites and/or scratches; being knocked down, jumped on, or pulled over by a dog; injuries related to the wrist and/or hand from the animal or leash, slips, and falls, hitting the head or other body parts on kennels; exposure to animal illness, parasites, fleas, and ticks; loss of and/or damage to personal property; damage to vehicles; damage to clothing from animals; picking up and handling dog waste; and exposure to cleaning products which contain chemicals. Potential Adopter hereby expressly and specifically assumes the risks to himself/herself, as well assumes the risks to his/her minor children, of injury or harm with respect to the activities and hereby releases Coastal from all liability for injury, illness, death, or property damage arising from visiting the Coastal property and facilities, as well as meeting, playing with, visiting, walking, and/or introducing Coastal rescue dogs to Potential Adopter, their family members, children, relatives, friends, and/or other pets owned by Potential Adopter. Potential Adopter fully, completely, and unconditionally (I) waives and releases Coastal from all liabilities, losses, duties, claims, charges, demands, actions, damages, costs, attorney fees, and expenses of whatever kind and nature that Potential Adopter may have now or in the future against Coastal relating to the meeting, playing with, visiting, walking, and/or introducing Coastal rescue dogs to Potential Adopter, and (ii) covenants not to assert any cause of action against Coastal. Potential Adopter on his/her own behalf and on behalf of her/his heirs, executors, administrators, and assigns hereby and forever agree to defend, indemnify, and hold harmless Coastal, and forever discharge Coastal and their successors and assigns from any and all liability, claims, and demands, of whatever kind or nature, either at law or in equity, which may arise from Potential Adopter’s activities with Coastal. Potential Adopter understands that this Release discharges Coastal from any liability or claim that Potential Adopter may have against Coastal with respect to bodily injury, personal injury, illness, death, or property damage that may result from the negligence of the parties comprising Coastal or otherwise.

POTENTIAL ADOPTER GRANTS RIGHTS TO COASTAL. Potential Adopter does hereby grant unto Coastal all right, title and interest in any and all photographic images and video or audio recordings made by Coastal during Potential Adopter’s activities with Coastal, including but not limited to any royalties, proceeds, or other benefits derived from such photographs or recordings.

RELEASE IS BROAD AND INCLUSIVE. Potential Adopter agrees that this Release is intended to be as broad and inclusive as permitted by the State of California and that this Release shall be enforced, governed by, and interpreted in accordance with the laws of the State of California. Potential Adopter agrees that in the event that any clause or provision of this Release shall be held invalid by any court of competent jurisdiction, the invalidity of such· clause or provision shall not otherwise affect the remaining provisions of this Release, which shall continue to be enforceable. Potential Adopter intends this Release to be in effect each and every time Potential Adopter participates in activities with Coastal. If the parties have any dispute regarding this Release or otherwise attempt the enforcement of this Release and a legal proceeding is initiated, the non-prevailing party in such legal proceeding shall pay to the prevailing party any and all attorneys and experts’ fees and costs, including court costs.

I DECLARE THAT I HAVE READ the Potential Adopters and Visitors Waiver and Release of Liability and agree to all terms therein, on behalf of myself and my minor children.

Certification of Identity and Agreement
By electronically submitting this Waiver and Release of Liability, I hereby represent and warrant that I am the person identified herein as the Visitor or Adopter. I acknowledge that I have read this document in its entirety, fully understand its contents, and voluntarily agree to be legally bound by all of its terms, provisions, releases, and acknowledgments. I further certify that the information provided by me is true and accurate, and I understand that this electronic submission shall have the same force and effect as an original handwritten signature.
