TTRR may show this agreement to any law enforcement agency as proof that I do not own transported pets and law enforcement may cite me with theft for refusing to return transported pets to TTRR.
*The animal(s) being fostered through Traveling Tails & Ragamuffin Rescue will herein be referred to as "the pet(s)".
1. I understand that by voluntarily signing this agreement, I am entering into a legal and binding contract with Traveling Tails & Ragamuffin Rescue. I understand that any misrepresentations in my application or this agreement are cause for Traveling Tails & Ragamuffin Rescue to declare this agreement in breach and request immediate return of the pet(s).
2. I agree to care for the animal(s) Traveling Tails & Ragamuffin Rescue places in my care, with the understanding that I will provide temporary shelter and care for the pet(s) who currently has nowhere else to live. I agree that this Transport Volunteer Agreement will apply to any and all pets that are in my care for transportation purposes. I understand that I will not be compensated for this service.
3. I understand and agree that the pet(s) is the property of Traveling Tails & Ragamuffin Rescue. I do not have any ownership of the pet(s); all such rights remain fully with Traveling Tails & Ragamuffin Rescue while the pet(s) is in my care. The pet(s) shall not be sold, given to, placed in the care of, offered, or delivered for adoption to another person, organization or any other entity including, but not limited to, a family member, friend, rescue facility, research facility, or shelter.
4. I agree to follow and abide by all of Traveling Tails & Ragamuffin Rescue’s rules, regulations, recommendations and policies.
5. I understand that Traveling Tails & Ragamuffin Rescue has made no representation concerning the health, condition, training, behavior, or temperament of the pet(s). I acknowledge that the pet(s) is transported “as is” and that no implied or expressed warranties have been made by Traveling Tails & Ragamuffin Rescue in reference to breed, health, training or temperament of the pet(s).
6. I will be professional and respectful in my dealings with Traveling Tails & Ragamuffin Rescue and with the general public. If at any time I wish to withdraw from this program, I will notify the Volunteer Coordinator.
7. I agree to contact Traveling Tails & Ragamuffin Rescue immediately in the case of: aggression, emergencies, medical issues, or a lost foster animal.
8. I agree to notify Traveling Tails & Ragamuffin Rescue of any change of my contact information (address, phone number(s), or email address) within 1 week of the change.
9. I agree to do my best to ensure the pet(s)’s safety and well-being while being transported. If transportation requires more than 12 hours of travel, I understand that an overnight stay will be arranged and I am to care for the pet for the duration of the transport.
10. I understand I will not be reimbursed for supplies that I purchase myself, unless previously agreed upon by a board member of Traveling Tails & Ragamuffin Rescue. I agree to return any property owned by Traveling Tails & Ragamuffin Rescue upon request or will be liable for the replacement cost of the same.
11. In the event of a life or death emergency, the pet(s) is to be immediately treated and I agree to notify the Volunteer Coordinator as soon as possible, within 12 hours. If the attending veterinarian feels the condition of or injuries to said pet(s) are not conducive to reasonable recovery or quality of life for the pet(s) and the pet(s) is suffering, the pet(s) is to be humanely euthanized. All emergency veterinary records and bills submitted for reimbursement must be in the name of Traveling Tails & Ragamuffin Rescue and reflect the name of the pet(s) as stated in their profile. Bills that do not reflect both items will not be reimbursed by Traveling Tails & Ragamuffin Rescue. I understand and agree that any non-emergency veterinary care will not be reimbursed and I will be responsible to pay those charges.
12. I agree the pet(s) will not be transported in the back of an open truck.
13. The pet(s) will not remain in vehicles unattended or unsupervised for more than 10 minutes when the outside temperature is less than 50 degrees Fahrenheit or more than 70 degrees Fahrenheit. The pet(s) will not remain in vehicles unattended or unsupervised for more than 45 minutes.
14. I agree the pet(s) will not be crated for more than 4 hours at a time, except while sleeping overnight, if needed. The crate must be large enough for the pet(s) to stand up, turn around and lay comfortably on his/her side.
15. I agree the pet(s) will always be under my control and supervision either on leash or in my vehicle, but I agree that I will never tie up or tether the pet(s).
16. I will not abuse or neglect the pet(s) or allow it to be abused or neglected. I authorize Traveling Tails & Ragamuffin Rescue, at its sole discretion, to determine whether or not the pet(s) has been abused or neglected while in my possession. I will not allow any physical, mental, or emotional abuse of the pet(s).
17. I am taking temporary possession of the pet(s) at my own risk and I release Traveling Tails & Ragamuffin Rescue, its officers, directors, members, employees, representatives, agents, or assigns from any and all liability arising out of possession of the pet(s). I hereby release Traveling Tails & Ragamuffin Rescue and its officers, directors, agents, and representatives and agree to indemnify and hold same harmless from any and all actions, causes of action, suits, debts, dues, accounts, covenants, agreements, judgements, claims and demand of any nature whatsoever arising out of my foster of the pet(s) from Traveling Tails & Ragamuffin Rescue.
18. I acknowledge that Traveling Tails & Ragamuffin Rescue may not be held liable should the pet(s) bite or injure a person or another animal while in my possession. I accept full liability for the pet(s) while in my care, recognizing the potential issues that may arise with any animal. In the event law enforcement impounds the pet(s) for any reason, I agree to accept any criminal complaint or summons for actions of the pet(s) that happened while in my possession or control. I will immediately notify the Volunteer Coordinator of such charges and will cooperate to resolve the charge in the best interest of Traveling Tails & Ragamuffin Rescue and the pet(s).
19. I agree that Traveling Tails & Ragamuffin Rescue will not be held liable for any damage or loss resulting from the failure of the pet(s) to respond to any commands taught to the pet(s) or resulting from counseling advice supplied to me. In the event any behavioral concerns arise, I will immediately notify Traveling Tails & Ragamuffin Rescue. Should any behavior of the pet(s) result in damage to property, myself, or another person or animal while in my possession, I agree to assume full liability to such third party for any and all such damage, and to absolve Traveling Tails & Ragamuffin Rescue from any and all obligations to pay such damage to third party.
20. I agree that Traveling Tails & Ragamuffin Rescue shall not be responsible for any bodily injuries or property damage and/or damage to other animals caused by the pet(s) or by my actions. I hereby specifically assumes sole responsibility for, and agrees to indemnify and hold Traveling Tails & Ragamuffin Rescue harmless from any and all loss and expenses (including legal fees) by reason of liability imposed by law upon the Traveling Tails & Ragamuffin Rescue or any of its officers, directors, members, employees, representatives, agents, or assigns because of bodily injuries or death to any person or persons including myself or those in my household, or any damage to property and/or animals arising out of or in consequence of the placement of the pet(s) howsoever such injuries, death or damage to property and/or animals may be caused, whether or not the same may have been caused, or may be alleged to have been accused, by negligence of the aforementioned parties or any of their directors, members, employees, representatives, agents, or assigns or any other person.
21. I acknowledge and agree that animal bites or other injuries to humans and other animals do occur and that all animals can carry and transmit parasites, diseases, including zoonotic diseases that can be transferred from animals to humans. I understand that Traveling Tails & Ragamuffin Rescue will not be responsible for the transmission or transfer of any disease or parasite to other animals or people in the fostering household and no attempt will be made by me or anyone on my behalf to hold Traveling Tails & Ragamuffin Rescue responsible.
22. I acknowledge that breach of this agreement may result in travel costs, court costs and attorney fees payable by me if legal action or travel is necessary for Traveling Tails & Ragamuffin Rescue to recover the pet(s). I understands that the pet(s) has intrinsic value and is not replaceable, so if the pet(s) is euthanized, lost or otherwise unable to be returned to the Traveling Tails & Ragamuffin Rescue, I may be found in breach of this agreement and will be subject to pay liquidated damages to the Traveling Tails & Ragamuffin Rescue in addition to all attorney's fees and costs and actual damages incurred as a result of the breach.
